Terms of Service

These Terms of Service (“Terms”) govern your use of BrandNameCheckr, available at brandnamecheckr.com (“the Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

BrandNameCheckr is a free, informational tool that checks the availability of a brand name across various third-party platforms including domain registries, social media networks, developer platforms, and community platforms. It also provides a “brand score” and links to official trademark databases.

The Service is provided free of charge with no registration required. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

2. Results Are Informational Only

All results provided by BrandNameCheckr are indicative and informational only. They do not constitute a guarantee of availability, legal clearance, or any right to use a name commercially.

Specifically:

  • Domain availability results reflect real-time DNS and RDAP lookups but may not account for pending registrations, reserved names, or registrar-specific restrictions. Always confirm availability directly with your chosen domain registrar before purchasing.
  • Social media and platform results are fetched directly from third-party platforms but may be delayed, rate-limited, or inaccurate due to platform changes, scraping restrictions, or temporary errors. Always verify directly on each platform before reserving a handle.
  • The brand score (0–100) is a heuristic indicator based on availability across checked platforms. It does not reflect trademark status, legal risk, or commercial viability.
  • Trademark links (USPTO, WIPO, UK IPO) direct you to official government databases. BrandNameCheckr does not perform trademark searches and does not interpret trademark status.

You are solely responsible for independently verifying all information before registering a domain, reserving a social handle, or committing to a brand name.

3. Not Legal, Trademark, or Business Advice

Nothing on BrandNameCheckr constitutes legal advice, trademark advice, or business registration advice.

Brand name availability on digital platforms is entirely separate from trademark law. A name may be available across all platforms we check and still be trademarked, legally protected, or otherwise unavailable for commercial use. Conversely, a name that appears taken on some platforms may still be registrable as a trademark or business name.

Before using any name commercially — including for a business, product, app, or service — you should consult a qualified trademark attorney in your jurisdiction.

4. Limitation of Liability

To the fullest extent permitted by applicable law, BrandNameCheckr and its operators shall not be liable for any loss or damage arising from:

  • Reliance on results, scores, or recommendations provided by the Service
  • Inaccurate, outdated, or incomplete availability information
  • Decisions to register a domain, reserve a social handle, or adopt a brand name
  • Trademark infringement, legal disputes, or business losses arising from use of a name
  • Downtime, errors, or interruptions to the Service
  • Actions or changes by third-party platforms that affect the accuracy of results

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Accuracy and Real-Time Limitations

BrandNameCheckr fetches availability data in real time from third-party sources. However:

  • Some platform checks may time out or fail silently, returning an “unknown” status
  • Platform availability can change within seconds of a check being performed
  • Some platforms actively block or rate-limit automated checks, which may produce inaccurate results

We make no representation that the Service is error-free or that results will be accurate at the time you act on them.

6. Acceptable Use

You agree not to use the Service to:

  • Scrape, crawl, or systematically extract data in bulk
  • Conduct automated or high-volume searches that place undue load on the Service or on third-party platforms
  • Attempt to reverse-engineer, interfere with, or disrupt the Service
  • Use the Service in any way that violates applicable laws or regulations

We reserve the right to block access to the Service at our discretion if we believe these terms are being violated.

7. Affiliate Links

Some links on BrandNameCheckr (such as domain registration links) are affiliate links. We may earn a small commission if you click and make a purchase through these links. This is at no extra cost to you and does not affect our availability results or recommendations in any way.

8. Third-Party Platforms and Links

The Service queries third-party platforms and displays links to external websites including trademark databases, domain registrars, and social networks. Some links, such as domain registration links, are affiliate links as described in Section 7. For all other platforms, we have no affiliation with, and are not endorsed by, those platforms.

We are not responsible for the content, availability, accuracy, or policies of any external websites. Use of linked external services is at your own risk and subject to those services' own terms of service.

9. Infrastructure and Service Providers

BrandNameCheckr is built on third-party infrastructure providers that we rely on to operate the Service:

Each of these providers operates under their own terms and privacy policies. We are not responsible for their practices. Our use of these providers does not grant them any rights to your data beyond what is described in our Privacy Policy.

10. Intellectual Property

The BrandNameCheckr name, logo, and original content of this website are owned by its operators. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written permission.

Brand names, trademarks, and platform names referenced in results (e.g. GitHub, Instagram, YouTube) are the property of their respective owners.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law and Disputes
